very quickly. by 9:00 a.m. just a little spotty activity south of san jose. by noon today almost completely clear over the greater bay area from the showers and we're also talking about sunshine at that point from santa rosa down to san mateo. still mostly cloudy until about 2:00 p.m. in san jose but we're going to see a nice, sunny finish to the day and highs will be in the upper 60s and low 70s everywhere across the bay area. traffic and weather go hand in hand. let's check on the morning commute with mike inouye. >> mostly cloudy and we're hearing mostly crowdy over at the toll plaza where we have the wet roads. look at that, the water kicks up some of the leftovers from last night's rain. there is the slow at the toll plaza. the map shows you it is moving smoothly but the yellow spots just below 60. i'm going to overlay some weather data. the green here you may have slicker conditions like the bay bridge toll plaza. this is west 580 into livermore, the earlier accident and two accidents reported have both completely cleared from the roadway. a lot of folks headed toward the d

records of any kind relating to discussions with any other agencies. the references to the san jose city attorney's office are dated 9 months after that. but i think what is really important is that there is a, i think, a reference in an e-mail that it was mr. st craw who spoke to the city attorney about taking these cases. so what we don't know is how this magically happened, nine months later. there are also no e-mails or other written communications of any kind internally within the staff or with any of the commissioners with one exception which i will give you in a moment. so there is no way to track how this all came about. >> it is obvious that none of you were directly involved in the decision, which considering that it involved your... it had to be completely transparent and it had to be one that everybody would accept. i did find an e-mail from the chairman. it surprised me. it said, it went to mr. san croy. read shaw's complaints is there not any reason that we can't release san jose's analysis about why st san croy's allegations fall. i don't know much about ethics but i know

of questions about your response. does that mean... are you aware of whether the san jose ethics commission has ever handled either on an advisorry basis or otherwise complaint referal from the different jurisdictional agencies? >> i have staffed the san jose election commission from 2008 and we have not ever accepted any such referals. >> has the elections commission made any referals themselves for matters to be handled by a agency outside of san jose? >> the election commission procedures and i think that our ethics ordinance do have some provisions for making referals. but that is generally in the nature of the district attorney office or their political practice commission. it would be something consistent with the jurisdiction of the selection commission but might possibly be ... there may be some criminal activity or some additional allegations that related to some violations of political format. not to another agency like the san francisco ethics commission or the oakland ethics commission. >> okay. thank you. very much. >> and any other questions for miss herrick on this matter? >> no.

york, oakland and san jose or santa clara mta. they all had higher scores than muni. muni was on the bottom. we included bart. since they said other systems did it we decided to look at the systems in paris france. it took months to identify the right officials and in this case either the head of operations or the systems schedulinger all but one which was new york agreed to an extensive interview by two of us and per the rules we were not identified. nevertheless of the interviews as described in the report were significant. all transit systems it became clear had multiple systems that were similar and had challenges and all needed to deal with complex traffic, scheduling, and terrain problems uniquely their own, and yet as we had known the san francisco controller's survey had shown all had higher reliability and rider seaferz than muni and we determined that all systems use switchbacks they only did so in cases of equipment break down or emergencies except for one. one system which happened to be the santa clara mta does use switch backs and interestingly enough th

this morning around the bay area but it's shifted a bit further to the south into san jose staying dry for most of halloween but now they are seeing the rain falling there. you can see those showers dragging on through. nothing really heavy, just some light rain coming through and beginning to fall apart. now, as we head through the day today, this is going to sag further south and move east so heading out of town into san jose, into milpitas, you're seeing more light early on this morning. roads are slick. so be careful. behind this we have some clearing on the back side. in fact, by the afternoon, probably turning to partly cloudy skies and just a slight chance of a few showers. overlooking san francisco now, still looking good. beautiful skies orange lights and temperatures in the 50s and 60s this afternoon maybe low 70s in the warmest spots but we are thinking 80s in the not too distant future. we'll tell you when coming up. right now let's check the roads with elizabeth. >> we can barely see the dublin interchange roads. westbound 580 in the commute direction, you can see some headlights.

now the roads are in the bay area and traffic looks good here so far. moving to san jose that traffic looks good getting to highway 17, it is light there are not many problems but there are a few as you just saw and it is a light commute getting into the city. let's go to steve. >> the rain seeps to be falling apart here and north of that. this morning's rain was done with this. rainfall totals for some and they had 1.50. there is not enough of a breeze to wipe this out. there is a little wave with a bend in the clouds as it comes in. it slows down and it keeps cloud cover coming in even though it is moving away from its parent source. it shows not a lot of rain in there but a lot of fog. we will be dealing with some of that thick fog and the nights are getting much longer and after that the weekend looks short. we will have a slow process he have clearing out and radar is still picking up some light rain very mild temperatures on the afternoon highs and we have a sunny break upper 60s to near 78 degrees. fog will be back nice and dreary and don't forget to set your clocks become a. >

and is live in san jose. how widespread is this problem? >> reporter: it's estimated there are hundreds of thousands of untested rape kits across the country waiting to be processed. but here in california, it's a different story. >> these are sealed and bind over to the police officer waiting for it. >> reporter: linda richards is a program manager for the sexual assault response team. she is also one of the nurses who performs extensive forensic exams on rape victims in santa clara county. >> it's not unusual to receive a phone call from a patient a week or so after and say you know, what did you find out about the swabs that came from my body. >> richards says the turnaround is about two months which is good considering the backlog in some states can force victims to wait years for the results. figures show in 2010 the state of illinois had processed just 20% of its rape kits. and in one county in michigan more than 11,000 rape kits were discovered untested. some dating back to the 1980s. the obstacle for many is the expense, processing one kit costs between 1200 and $3500. >> until

weather in san jose and sunnyvale. there is a light rain and prettmost folks are describing t as a light sprinkle. we are seeing some residual side showers on the back end. we could pick us was traced hours north of the golden gate bridge into the 11:00 hour. a lot of the clouds start to live and we will see more in a way of sunshine as we head into the afternoon complete the track conditions. it is shaping up to be a very nice day. temperatures are not too bad 60 out the door in hayward 57 in napa. it is not to chilly up there there is a slight breeze to contend with. we of cold air coming in with that front as we head into the afternoon mild conditions on tap. 67 for concord laid out in richmond, upper 60s in the south bay and 68 for santa rosa. the seven there on ave forecast shows sunshine as we head into the weekend. >> the dow jones industrial average over up at 1%. u.s. builders are increasing their spending at 0.6% in september for home construction of some solid gains. net flicks that shares were up 13%. the shares are now dropping 4% as the rating was downgraded for net flicks.

or in san jose which is being done now? i'm not one of the quarter million dollars candidates but i've raised several thousand dollars, buttons, website, campaign essentials all produced here in san francisco. homelessness and panhandling, when friends visit from out of town they are aghast at the number of people on the streets. some are truly destitute. on the other end of the spectrum, some have homes. compassion, resources and outreach are crucial, but we also need city government to know that we won't tolerate people fighting, stealing, making messes or harassing residents, shoppers and visitors. i applaud the mayor for recently working with police, dph and the courts to institute mandatory treatment for the most chronic and costly individuals. but we also need law enforcement to tell people that they can't rome around town or come in from outside the city to block sidewalks and beg for change. this is a tough topic to tackle without sounding like some uncompassionate right wing jerk, but the situation is getting worse and we need to do what is best for everyone, including resi
